A. Information Collected by DH or on Behalf of DH

DH collects two kinds of information: (1) Personally identifiable information (“Personal Information”) voluntarily provided by visitors through optional registration or other methods and (2) non-personally identifiable information routinely gathered as visitors navigate through the Website.

You are free to visit and use the Website without providing any Personal Information. However, DH offers services on the Website that require registration and/or submission of Personal Information. In order to register or otherwise take advantage of the products and personalized services that are offered on the Website, you will have to provide Personal Information. The Personal Information DH might request from you may include your name, address, email address, phone number and, if you are making a purchase of goods or services, your billing and credit card information. In some cases, DH must share your Personal Information in order to fulfill your request(s). Registration & Member Profile
In order to obtain access to certain products, services, and/or content available on the Website, you must complete a registration form. The Registration Form and Member Profile pages request that you submit a variety of information, such as: your name, a selected username and password, email address, mailing address, zip code, gender, height, weight, age, credit card information (if you are making a purchase of goods or services), desired weight, health information (e.g., diabetes, heart disease, etc.), lifestyle preferences (e.g., activity level, favorite foods, etc.), and other diet or lifestyle-related information to help us design and personalize your diet and/or exercise program. DH uses the Personal Information you provide through registration to recommend and customize diet, meal, and fitness plans; bill you and conduct other billing and account activity; and respond to any questions that you submit. From time to time DH might need to update you about your account, contact you regarding a billing question, notify you about changes to services, or otherwise send you service-related announcements. You will not be able to unsubscribe from these transactional emails. You will be permitted to unsubscribe from all other emails that are not transactional in nature.
In those circumstances, DH will use your Personal Information to contact to you. By registering for services, you consent to DH contacting you about your account. Based upon the Personal Information you provide us, DH will send you a welcoming email to verify your username and password. DH may also call you at the telephone number that you provide in your registration to welcome you to DH. From time to time DH may call you to check in on your diet or exercise progress and offer non-sales related mentoring assistance. If you do you not wish DH to contact you regarding your account or your progress, please do not register on the Website. You are of course free to unsubscribe to any other emails that you receive from us.
Emails & Newsletters
You may register to receive email subscriptions and newsletters from DH by opting in to receive the subscriptions or newsletters of your choosing. To receive emails and newsletters from DH you must provide your email address. DH also offers a “Tell a Friend” (a.k.a. “Refer a Friend”) feature that enables you to send articles and other content to your friends. When you use DH’s “Tell a Friend” feature, DH uses your friend’s email address only for the purposes stated, such as sending your friend the article or content you requested or creating temporary login information for advanced access to software in beta testing stages and for no other purpose, unless otherwise disclosed to you at the time you send the email.
Surveys or Contests
From time-to-time DH may provide you the opportunity to participate in contests, sweepstakes, promotions or surveys on or through the Website. If you participate, DH will request certain Personal Information from you. Participation in these contests, sweepstakes, or surveys is completely voluntary and you therefore have a choice whether or not to disclose this information. Sometimes DH may offer these contests or sweepstakes together with another party, or DH may use a third party service provider to help us conduct the promotion. DH will notify you within the Official Rules of promotions if another party is co-sponsoring the promotion with us. Editorial orInterview Requests
A member of the DH editorial team may contact members via email, telephone or postal mail for potential interviews and feature stories. Testimonials and Success Stories are effective tools in communicating the results of programs available from DH. Participation in editorial or interview requests is strictly voluntary and you are free to refuse to participate. 3. Non-personally Identifiable Information

Web Beacons
DH third party advertising partners use a software technology called clear gifs (a.k.a. Web Beacons/Web Bugs) that help us to validate sales on the Website. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of Web users. In contrast to cookies which are stored on a user’s computer hard drive, clear gifs are embedded invisibly on web pages and are about the size of the period at the end of this sentence. DH does not tie the non-personal information gathered by clear gifs to your Personal Information, and DH does not use web beacons to collect any Personal Information from or about you or to track your activities across websites generally.
Log Files
DH gathers certain information automatically and store it in log files, as do most websites. This information includes internet protocol (IP) addresses, browser type, referring/exit pages, operating system, date/time stamp, and clickstream data. DH uses this information (which does not identify individual users) to analyze trends, to administer the Website, and to identify and solve hardware and software problems as they arise. 4. Information from Other Sources

C. Children
DH is committed to protecting the privacy of children. This Website is not designed for, nor is it intended to attract, children under the age of 13. DH does not knowingly collect Personal Information directly from any person under the age of 13, and if DH does inadvertently collect information from a person under the age of 13, DH deletes it as soon as DH discovers it.
D. Public Forums
As mentioned above, this Privacy Policy does not protect you when you use DH public forums. As a service to the Website users, DH features chat rooms and bulletin boards where users can share diet, nutrition, and/or fitness information and support one another or post questions for experts to answer. In addition, DH offers online discussions on a variety of topics moderated by experts. You should be aware that any information shared in a chat room, bulletin board, or online discussion is public information and may be seen, disclosed to, or collected by third parties that do not adhere to the DH Privacy Policy. INFORMATION DISCLOSURE
Except as set forth in this Privacy Policy or as specifically agreed to by you, DH will not disclose any Personal Information it gathers from you on the Website without your prior permission. Except as set forth herein, you will have the opportunity to opt-in to DH sharing your Personal Information with third parties, and you can withdraw your consent to DH sharing your information at any time.

C. Disclosure to Outside Contractors
DH may employ independent contractors, vendors and suppliers (collectively, “Outside Contractors”) to provide specific services and products related to the Website, including but not limited to maintaining an email suppression list as required by state and/or federal law; hosting and maintaining the chat rooms; providing credit card processing and shipping fulfillment; fraud screening; testing and implementation of special services such as those for contacting members to offer personal, one-on-one, nutritional and member support to help members to reach their goals; and developing applications for the Website and email services. These Outside Contractors may sometimes have limited access to information collected on the Website, including your Personal Information, in the course of providing products or services to us. Access to your Personal Information by these Outside Contractors is limited to the information reasonably necessary in order for the Outside Contractors to perform their limited function for us.
D. Disclosure to Third Party Sellers
Through the Website, you may be given the opportunity to purchase (or to obtain more information) regarding certain content, products or services which are sold through a person or company other than us or DH Affiliates (collectively, “Third Party Sellers”). E. Disclosure to or by Co-branded Channel Partners
DH is a contractor and provides co-branded content and services to websites hosted and operated by companies other than DH (“Channel Partner Websites”). You can only access these co-branded content and services through the Channel Partner Website, and usually through the diet or health sections of these other websites. The co-branded DH pages that you may access through a Channel Partner Website have different registration processes and opportunities for information collection, and Personal Information that you provide on these pages may be shared with the Channel Partners. Each of these co-branded DH websites has its own privacy policy posted on that site, which explains what information is disclosed by and between the hosting parties. F. Disclosure to Linked Sites
In addition to the third party websites that you may access as described above, for your convenience there are links to websites operated by companies other than DH (“Third Party Websites”) that are not contractors who provide content or services through the Website. G. Other Disclosures
DH reserves the right to transfer information to a third party in the event of a sale, liquidation, merger, or other transfer of all or substantially all of the assets of DH.
